The U.S. International Trade Commission (ITC) Recently Launched A Section 337 Investigation Targeting Certain Wireless Communication Devices And Their Components

The U.S. International Trade Commission (ITC) has officially kicked off a Section 337 investigation into certain wireless communication devices and their components. OnePlus, TCL, and several other companies are named as respondents.

 

Quick background: Back on December 16, 2025, a bunch of U.S. companies filed a complaint with the ITC. They claim that some wireless comm products being imported into the U.S., sold for import, or sold here after import are infringing their patents (or other IP rights protected under Section 337). They're asking the ITC to slap limited exclusion orders (basically banning those products from entering the U.S.) and cease-and-desist orders on the companies involved.

 

On January 15, 2026, the ITC voted to start the formal investigation.

 

The named respondents include:

 

  • U.S. companies: BLU Products (Florida), Coosea USA Technologies (San Diego), DISH Wireless, EchoStar, Qualcomm Technologies, T-Mobile USA, TTE Technology (doing business as TCL North America in Irvine, CA)
  • Korea: LG Electronics
  • Mainland China: Shenzhen Wanplus Technology Co., Ltd. (this is the parent company behind OnePlus), TCL Technology Group Corporation
  • Hong Kong: TCL Communication Ltd.
  • Taiwan: HTC Corporation

(So yeah, it's a pretty mixed bag-phone brands, carriers, chip makers, all tangled up in what looks like a wireless patent fight.)

 

The ITC will set a target date to wrap up the investigation within the next 45 days. If they eventually rule that there's infringement, they can issue remedies like import bans. Unless the U.S. Trade Representative steps in and vetoes it for policy reasons (which is rare), those orders take effect the day they're issued and become final 60 days later.

 

These 337 cases are super common in the tech world, especially for phones, chips, and wireless stuff. If the ITC sides against any of these companies, it could seriously hurt their ability to sell in the U.S. market. We'll see how the respondents fight back.
